1. THE "OFF MARKET" MANDATE

Off Market (“Company”) is a private, boutique matchmaking consultancy. By accessing this site, you acknowledge that we are not a public dating app. Admittance into "The Vault" or our scouting database is by invitation only and at the sole discretion of the Company. We reserve the right to refuse service or "Audit" requests to anyone, for any reason, without explanation.

2. ELIGIBILITY & VETTING

By using this site or inquiring for services, you represent and warrant that:

  • Status: You are legally single (not currently married or in a committed domestic partnership).

  • Character: You have never been convicted of a felony or any crime involving violence, fraud, or sexual misconduct.

  • Accuracy: All information, including professional status and age, is 100% accurate.

3. STATUTORY CANCELLATION RIGHTS (CALIFORNIA CIVIL CODE § 1694.1)

Notice to Buyer:

You, the buyer, may cancel this agreement, without any penalty or obligation, at any time prior to midnight of the third business day after the date of this agreement. To cancel this agreement, mail or deliver a signed and dated notice, or send an email which states that you, the buyer, are canceling this agreement, or words of similar effect. This notice shall be sent to:Off Market via email to ilana@offmarketmember.com.

4. DEATH, DISABILITY, OR RELOCATION (CAL. CIV. CODE § 1694.3)

As required by California law, if you are unable to receive services due to death or a disability that prevents you from using the service, you (or your estate) are relieved from further payment obligations. If you relocate more than 100 miles from the Company’s primary service area, you may elect to cancel and receive a pro-rata refund.

5. THE "VAULT" PRIVACY & DATA (2026 CALIFORNIA DELETE ACT)

We are committed to the California Delete Act (SB 362).

  • The Sanctuary Guarantee: Your data is never sold, shared, or indexed.

  • Right to Deletion: You have the right to request the total deletion of your profile from our offline "Vault" at any time. We process all such requests through the California Privacy Protection Agency's DROP platform or direct request within 45 days.

6. NO GUARANTEE OF OUTCOME

You acknowledge that the Company provides a Process-Based Service, not an Outcome-Based Service. While we provide hand-vetted introductions and behavioral audits, human chemistry is subjective. We do not guarantee a specific number of matches, a marriage, or a long-term relationship.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Off Market’s liability for any claim arising out of your use of this site or our services is limited to the total amount of fees paid by you to the Company. We are not liable for the conduct, actions, or omissions of any third-party matches.

8. NARROW ARBITRATION & PREVAILING PARTIES (SB 82 COMPLIANCE)

Pursuant to California Civil Code § 1670.15 (Effective Jan 1, 2026):

  • Scope: Any dispute arising directly out of the use, payment, or provision of services under this specific agreement shall be settled by binding arbitration in Los Angeles, California via JAMS.

  • No "Infinite" Clauses: This arbitration agreement does not apply to unrelated future disputes or ancillary tort claims not arising from this contract.

  • Attorneys' Fees: The prevailing party in any arbitration or legal action shall be entitled to recover reasonable attorney's fees and costs.

9. BEHAVIORAL CODE OF CONDUCT

We maintain a "Zero-Tolerance" policy for harassment, ghosting, or disrespectful behavior toward our staff or matches. Violation of this code is grounds for immediate termination of your membership without a refund.
